Throughout these Terms, "Maxxima Welding Supply," "we," "us," and "our" refer to Maxxima Welding Supply. "You" and "your" refer to any person or entity accessing the Site, using our Services, or purchasing products from us.

Please read these Terms carefully before accessing the Site or purchasing our products.

By accessing or using any part of the Site, creating an account, submitting an order, purchasing a product, or otherwise using our Services, you agree to be bound by these Terms and by the policies incorporated into these Terms, including our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree to these Terms, you should not access or use the Site or Services.

Our online store is hosted using the Shopify e-commerce platform. Shopify provides technology that enables us to operate our online store and offer products to customers. Purchases from Maxxima Welding Supply are transactions between you and Maxxima Welding Supply, subject to these Terms and applicable law.

SECTION 1 — ELIGIBILITY AND ONLINE STORE USE

By using the Site or purchasing products from us, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have obtained any parental or legal guardian consent required by applicable law.

You may use the Site and Services only for lawful purposes.

You may not use our products, Site, or Services in violation of any applicable local, state, federal, national, or international law or regulation.

You may not transmit viruses, worms, malicious code, malware, or other technologies designed to interfere with, damage, disrupt, or obtain unauthorized access to the Site, Services, systems, or information.

We may suspend or terminate access to the Services for violations of these Terms, subject to applicable law.

SECTION 2 — GENERAL CONDITIONS

We reserve the right, to the extent permitted by applicable law, to refuse or cancel service or orders for legitimate reasons, including suspected fraud, payment irregularities, unlawful activity, misuse of the Site, violations of these Terms, or other circumstances reasonably requiring us to protect our customers or business.

We may modify, suspend, restrict, or discontinue portions of the Site or Services from time to time, subject to applicable law.

You may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of the Site or Services without our prior written permission, except where permitted by applicable law.

Headings used in these Terms are provided for convenience only and do not affect their interpretation.

SECTION 3 — PRODUCT INFORMATION AND SPECIFICATIONS

We make reasonable efforts to provide accurate product descriptions, photographs, specifications, dimensions, compatibility information, pricing, and other product information.

However, manufacturing variations, supplier changes, product updates, photography, display settings, measurement methods, and other factors may result in minor differences between products and their online representations.

Product photographs are provided primarily for identification and reference. Colors, finishes, packaging, markings, labels, proportions, and other non-material characteristics may differ from photographs unless expressly stated otherwise.

Product specifications and information may be updated from time to time without notice.

We reserve the right to correct typographical errors, inaccurate specifications, pricing errors, availability errors, or other mistakes on the Site, including after an order has been submitted, subject to applicable law.

If a material error affects an order you have already placed, we may contact you to provide corrected information or, where appropriate, offer cancellation and a refund.

SECTION 4 — PRODUCT COMPATIBILITY AND CUSTOMER RESPONSIBILITY

Maxxima Welding Supply sells products that may include replacement parts, consumables, accessories, components, and related products for welding, cutting, fabrication, laser, plasma, MIG, TIG, and other industrial equipment.

References to brands, equipment models, torch models, welding heads, part numbers, dimensions, OEM references, or other compatibility information are provided to assist customers in identifying potentially compatible products.

Unless expressly stated otherwise, references to a third-party manufacturer, brand, trademark, equipment model, or part number do not mean that the product is manufactured, authorized, sponsored, endorsed, or approved by that third party.

Before ordering, installing, or using a product, you are responsible for confirming that the product is appropriate for your intended application, including verifying applicable:

  • Dimensions
  • Specifications
  • Part numbers
  • Equipment models
  • Operating parameters
  • Materials
  • Electrical requirements

  • Process requirements
  • Other compatibility factors

If you are uncertain about compatibility, we encourage you to contact Maxxima Welding Supply before purchasing or installing the product.

Any compatibility assistance or product recommendation we provide is based on information reasonably available to us and information supplied by the customer. You remain responsible for verifying final suitability for your equipment and intended application.

Nothing in this Section excludes or limits rights that cannot lawfully be waived.

SECTION 5 — INDUSTRIAL EQUIPMENT AND SAFETY

Products purchased from Maxxima Welding Supply must be installed, operated, maintained, inspected, and replaced in accordance with applicable manufacturer instructions, equipment documentation, recognized safety practices, workplace safety requirements, and applicable law.

The customer, employer, installer, and operator are responsible, as applicable, for ensuring appropriate training, supervision, protective equipment, ventilation, safeguards, and operating procedures.

Installation, modification, repair, or servicing of industrial equipment should be performed only by persons appropriately trained and qualified for the work involved.

Safety systems, guards, interlocks, protective housings, or other safety features should not be defeated, bypassed, removed, or improperly modified.

To the extent permitted by applicable law, Maxxima Welding Supply is not responsible for injury, property damage, equipment damage, or other loss to the extent caused by misuse, improper installation, unauthorized modification, operation outside applicable specifications, failure to follow manufacturer instructions or safety requirements, or use of a product for an inappropriate application.

Nothing in this Section limits liability that cannot lawfully be limited or excluded.

Certain products sold by Maxxima Welding Supply may be intended for industrial laser welding, cutting, cleaning, or related laser applications.

High-power industrial lasers can cause serious or permanent eye injury, burns, fire, equipment damage, and other hazards.

Protective lenses, cover lenses, optical components, nozzles, accessories, replacement components, and consumables are equipment components and are not substitutes for appropriate engineering controls, protective enclosures, interlocks, personal protective equipment, training, or other required safety measures.

Customers and operators are responsible for ensuring that laser equipment is operated by appropriately trained personnel and in accordance with manufacturer instructions, applicable safety standards, workplace requirements, and applicable law.

Before installing or using any optical component, lens, protective window, replacement part, or laser consumable, the customer is responsible for verifying its suitability for the applicable laser wavelength, power level, equipment configuration, operating environment, and intended application.

SECTION 7 — PRODUCT USE, INSTALLATION, AND ASSUMPTION OF RISK

Products sold by Maxxima Welding Supply may be intended for use with welding, cutting, plasma, laser, fabrication, and other industrial equipment capable of producing high temperatures, electrical hazards, intense optical radiation, fumes, sparks, molten material, pressurized gases, fire hazards, and other potentially dangerous conditions.

By purchasing or using a product from Maxxima Welding Supply, you acknowledge that the installation and use of industrial equipment, replacement parts, consumables, optical components, and accessories may involve inherent risks and require appropriate knowledge, training, equipment, and safety precautions.

You are responsible for ensuring that any product purchased from Maxxima Welding Supply is properly selected, inspected, installed, operated, maintained, and replaced in accordance with the equipment manufacturer's instructions, applicable product documentation, operating specifications, recognized safety practices, and applicable laws and regulations.

Before installation or use, you are responsible for confirming that the product is compatible with your equipment and intended application, including applicable dimensions, materials, electrical characteristics, optical characteristics, laser wavelength and power requirements, pressure or flow requirements, operating parameters, and other relevant specifications.

You should not use a product that appears damaged, defective, contaminated, improperly manufactured, incorrectly dimensioned, or otherwise unsuitable for its intended application. If you believe a product supplied by Maxxima Welding Supply may be defective or unsuitable, discontinue use and contact us before installing or continuing to use the product.

  • The customer and equipment operator are responsible for evaluating the risks associated with their particular equipment, workplace, process, materials, and application and for implementing appropriate engineering controls, administrative controls, training, supervision, and personal protective equipment.

Nothing in this Section excludes, restricts, or modifies any liability, warranty, consumer protection, or other legal right that cannot lawfully be excluded, restricted, or modified under applicable law.

SECTION 8 — PRICES AND AVAILABILITY

Prices are subject to change without notice.

Unless otherwise stated, displayed prices may exclude applicable taxes, shipping charges, customs duties, brokerage fees, or other charges.

Product availability is not guaranteed.

We may modify or discontinue products and may reasonably limit quantities available to a particular customer, account, business, household, payment method, shipping address, or order.

We may cancel an order if a product is unavailable, materially mispriced or misdescribed, affected by a technical error, subject to a legal restriction, or otherwise cannot reasonably be fulfilled.

If we cancel an order after payment has been processed, we will refund the applicable amount.

SECTION 9 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase products from Maxxima Welding Supply.

Receipt of an automated order confirmation does not necessarily constitute final acceptance of an order.

We may accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability
  • Pricing or listing errors
  • Payment problems
  • Suspected fraud
  • Shipping restrictions
  • Legal restrictions
  • Unusually large or irregular orders
  • Suspected unauthorized resale activity

If we cancel all or part of an order after payment has been processed, we will refund the applicable canceled amount.

You are responsible for providing complete and accurate billing information, shipping information, contact information, and product selections.

You agree to provide current, complete, and accurate payment and billing information for purchases made through the Site.

You represent that you are authorized to use any payment method submitted in connection with an order.

Payments may be processed by Shopify Payments or other third-party payment processors made available through our Site.

Payment providers may process payment and transaction information according to their own terms, privacy policies, security practices, and legal obligations.

We do not guarantee that every payment method will remain available at all times.

Applicable taxes may be calculated and collected as required by law.

Our handling of personal information associated with purchases and payments is further described in our Privacy Policy.

SECTION 11 — SHIPPING AND DELIVERY

Products are shipped according to the shipping methods, rates, and policies made available through the Site.

Unless expressly guaranteed in writing, processing, shipping, and delivery dates are estimates and are not guaranteed.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, supply disruptions, customs processing, incorrect addresses, holidays, labor disruptions, governmental actions, and other events.

You are responsible for providing a complete and accurate shipping address.

Additional expenses resulting from an incorrect or incomplete address, refused shipment, failed delivery attempt, or requested redirection may be charged to you where permitted by law.

Our current Shipping Policy is incorporated into these Terms by reference.

SECTION 12 — RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, and exchanges are governed by the Refund Policy published on our Site, which is incorporated into these Terms by reference.

You should review the Refund Policy before making a purchase.

Nothing in our Refund Policy or these Terms limits any return, refund, cancellation, warranty, or other right that cannot lawfully be waived.

SECTION 13 — WARRANTIES

Products sold by Maxxima Welding Supply may be covered by warranties provided by the original manufacturer, supplier, or another third party.

Where a third-party warranty applies, its scope, duration, conditions, exclusions, and remedies are determined by the applicable warrantor.

Unless we expressly identify a warranty as a written warranty provided directly by Maxxima Welding Supply, we do not independently extend or modify a manufacturer's or supplier's warranty.

Any express written warranty provided directly by Maxxima Welding Supply will be governed by the specific terms accompanying that warranty.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY SPECIFICALLY PROVIDED BY MAXXIMA WELDING SUPPLY, PRODUCTS AND SERVICES ARE PROVIDED SUBJECT TO THE WARRANTIES AND RIGHTS THAT APPLY UNDER APPLICABLE LAW.

Nothing in these Terms is intended to disclaim, restrict, or modify an implied warranty, statutory warranty, consumer guarantee, or other right that cannot lawfully be waived.

Any applicable written consumer-product warranty will be made available as required by applicable law.

SECTION 14 — THIRD-PARTY PRODUCTS, COMPATIBILITY REFERENCES, AND TRADEMARKS

Maxxima Welding Supply may sell compatible replacement parts, consumables, accessories, and components intended for use with equipment manufactured by third parties.

Third-party company names, trademarks, equipment names, model numbers, product names, and part numbers may be used solely for identification, compatibility, comparison, or informational purposes.

All third-party trademarks and intellectual property remain the property of their respective owners.

Unless expressly stated otherwise, use of a third-party name or reference does not imply affiliation, sponsorship, endorsement, authorization, or approval by the applicable third party.

SECTION 15 — SHOPIFY AND THIRD-PARTY SERVICES

Our online store is hosted using Shopify.

Shopify provides the e-commerce infrastructure that enables us to operate the Site and may provide functionality relating to checkout, payments, customer accounts, fraud prevention, analytics, and other e-commerce services.

Your use of certain Shopify functionality may also be subject to Shopify's applicable terms and privacy practices.

The Site may also use or provide access to third-party services, including payment processors, shipping carriers, analytics providers, marketing providers, communication services, social-media platforms, or other technology providers.

These services may be independently operated and may be governed by their own terms and privacy policies.

To the extent permitted by applicable law, Maxxima Welding Supply is not responsible for the independent content, availability, security, terms, privacy practices, products, or services of third parties.

SECTION 16 — PRIVACY, COOKIES, ANALYTICS, AND ADVERTISING

Our collection, use, disclosure, retention, and other processing of personal information is described in our Privacy Policy.

The Site may use cookies, pixels, tags, analytics technologies, and similar technologies for purposes including Site functionality, security, fraud prevention, analytics, performance measurement, and, where applicable, marketing or advertising.

Where required by applicable law, we may provide privacy controls relating to cookies, targeted advertising, sale or sharing of personal information, or other covered processing activities.

Our Privacy Policy describes these practices and applicable privacy choices in greater detail.

If there is a conflict between these Terms and the Privacy Policy concerning how personal information is handled, the Privacy Policy will govern with respect to that privacy matter.

SECTION 17 — USER COMMENTS, REVIEWS, AND SUBMISSIONS

If you submit reviews, photographs, comments, suggestions, ideas, feedback, testimonials, or other content ("Submissions"), you represent that you have the right to provide the Submission and that doing so does not violate the rights of another person or entity.

Submissions must not contain unlawful, fraudulent, defamatory, threatening, obscene, abusive, infringing, deceptive, misleading, or malicious content.

You may not impersonate another person or misrepresent the source of a Submission.

By providing a Submission, you grant Maxxima Welding Supply a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and publish the Submission for legitimate business purposes, including operating, improving, and promoting our Services, subject to applicable law and our Privacy Policy.

We may decline to publish or may remove Submissions where reasonably appropriate.

SECTION 18 — INTELLECTUAL PROPERTY

Content available through the Site, including text, photographs, graphics, product presentations, logos, designs, videos, layouts, and original materials, is owned by or licensed to Maxxima Welding Supply or its applicable licensors and may be protected by copyright, trademark, and other intellectual-property laws.

You may access and use the Site for personal use or legitimate business purchasing purposes.

Except as permitted by law or with our prior written authorization, you may not reproduce, republish, distribute, modify, commercially exploit, systematically extract, scrape, or create derivative works from protected Site content.

Third-party trademarks and intellectual property displayed on the Site remain the property of their respective owners.

SECTION 19 — ERRORS, INACCURACIES, AND OMISSIONS

The Site may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, specifications, dimensions, compatibility, pricing, promotions, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when appropriate.

If a material error affects an order you have already submitted, we may contact you to correct the order or cancel the affected portion, subject to applicable law.

(k) engage in threatening, abusive, defamatory, discriminatory, or otherwise unlawful conduct; or

(l) circumvent security controls, purchasing restrictions, access controls, or technical limitations.

We may suspend or terminate access to the Site or Services for prohibited use, subject to applicable law.

SECTION 21 — TECHNICAL INFORMATION AND PRODUCT ASSISTANCE

Technical information provided through the Site, product descriptions, compatibility charts, specifications, email, or customer service is intended to assist customers in evaluating products.

Such information is not a substitute for:

  • Equipment manufacturer instructions
  • Equipment manuals
  • Safety documentation
  • Engineering evaluation
  • Professional advice
  • Required training
  • Workplace safety procedures

You remain responsible for determining whether a product is appropriate for your particular equipment, materials, processes, operating conditions, and intended application.

Where we provide compatibility assistance based on information you supply, you are responsible for ensuring that the information supplied is accurate and complete.

SECTION 22 — DISCLAIMER OF SERVICES

We make reasonable efforts to maintain the availability and functionality of the Site and Services, but we do not guarantee that the Site will always be uninterrupted, error-free, secure, or available.

The Site may occasionally be unavailable because of maintenance, technical problems, service-provider interruptions, security incidents, or circumstances outside our reasonable control.

To the maximum extent permitted by applicable law, use of the Site is at your own risk.

Nothing in this Section excludes warranties, guarantees, duties, or other rights that cannot lawfully be excluded.

SECTION 23 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Maxxima Welding Supply will not be liable for personal injury, property damage, equipment damage, loss of production, downtime, loss of profits, or other loss to the extent resulting from improper installation, misuse, abuse, unauthorized modification, incompatible equipment, incorrect product selection, operation outside applicable specifications, failure to follow manufacturer instructions or safety requirements, or use of a product contrary to its intended purpose or applicable documentation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAXXIMA WELDING SUPPLY AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF PRODUCTION, DOWNTIME, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THE FOREGOING EXCLUSIONS AND LIMITATIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms is intended to exclude or limit liability for a defective product, personal injury, death, gross negligence, willful misconduct, fraud, or any other liability to the extent such liability cannot lawfully be excluded or limited.

Because some jurisdictions do not permit certain exclusions or limitations of liability, some of the limitations above may not apply to you. In those jurisdictions, liability will be limited only to the maximum extent permitted by applicable law.

SECTION 24 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Maxxima Welding Supply and its owners, officers, employees, affiliates, agents, contractors, suppliers, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

(a) your material breach of these Terms;

(b) your unlawful use of the Site or Services;

(c) your violation of another person's rights;

(d) your misuse, abuse, unauthorized modification, or unlawful use of a product purchased from us;

(e) your improper installation or maintenance of a product; or

(f) your use of a product with equipment or in an application for which the product is not compatible or suitable.

This provision does not require you to indemnify Maxxima Welding Supply for liability arising solely from our own conduct where such indemnification is prohibited by applicable law.

SECTION 25 — FORCE MAJEURE

To the extent permitted by applicable law, Maxxima Welding Supply will not be responsible for delay or failure to perform caused by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, labor disruptions, epidemics or pandemics, government actions, transportation disruptions, carrier delays, power failures, telecommunications failures, cyber incidents, supplier failures, material shortages, or other events beyond our reasonable control.

Nothing in this Section affects rights that cannot lawfully be waived.

SECTION 26 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will remain in full force and effect.

SECTION 27 — WAIVER

Our failure or delay in exercising or enforcing a right or provision under these Terms does not constitute a waiver of that right or provision.

A waiver relating to one circumstance does not constitute a waiver of the same or another provision in the future.

SECTION 28 — TERMINATION

These Terms remain effective while you use the Site or Services.

You may stop using the Services at any time.

We may suspend or terminate access where reasonably appropriate because of violations of these Terms, suspected fraud, unlawful conduct, security concerns, or other legitimate grounds, subject to applicable law.

Provisions that by their nature should survive termination will remain effective, including provisions concerning product use and safety, intellectual property, warranties, limitations of liability, indemnification, governing law, and accrued payment obligations.

SECTION 29 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and Maxxima Welding Supply concerning your use of the Services and purchases made through the Site.

These Terms supersede prior versions of our Terms of Service concerning the same subject matter.

Nothing in these Terms excludes representations, protections, statutory rights, or other rights that cannot lawfully be excluded.

SECTION 30 — GOVERNING LAW

These Terms and any dispute arising out of or relating to these Terms, the Site, our Services, or transactions with Maxxima Welding Supply will be governed by the laws of the State of California, without regard to its conflict-of-law principles, except to the extent applicable federal law or another mandatory law applies.

Nothing in these Terms deprives a consumer of protections or rights that cannot lawfully be waived under applicable law.

SECTION 31 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our business, Site, products, Services, technology, business practices, policies, service providers, or applicable laws and regulations.

The current version will be posted on the Site with an updated "Last Updated" date.

Updated Terms become effective when posted or on any later effective date stated in the updated Terms, subject to applicable law.

Your continued use of the Site or Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Changes will not retroactively alter rights or obligations relating to completed transactions where prohibited by applicable law.
